IMPORTANT NOTICE — SALE RESTRICTED TO PERSONS AGED 18 OR OVER. The products sold on this website are intended exclusively for persons aged 18 or over. Purchase by persons under 18 is not permitted, nor may an adult purchase on behalf of, or for the benefit of, a minor. By completing an order, the customer declares, on their honour, that they are over 18, and may be asked to provide proof of age at any time before dispatch. The full conditions are set out in clause 3.
This website, www.mundilar.net (hereinafter the "website" or the "shop"), is owned and operated by:
Mundilar Airguns operates exclusively online and has no premises open to the public.
2.1. These Terms and Conditions of Sale (hereinafter the "Terms") govern the distance sales contracts concluded through the website between Mundilar Airguns and its customers.
2.2. By completing an order, the customer declares that they are over 18 and that they have read, understood and fully accepted these Terms, as well as the Privacy Policy and the Cookie Policy.
2.3. The version of the Terms in force on the date the order is completed applies to each contract. A copy of the applicable Terms is sent to the customer on a durable medium together with the order confirmation.
2.4. For the purposes of these Terms, consumer means a natural person who acquires goods for non-professional use, within the meaning of Lei n.º 24/96, de 31 de julho (Law No. 24/96 of 31 July). Clauses 8 (right of withdrawal), 9 (legal guarantee of conformity) and 10 (complaints and dispute resolution) apply to consumers only. Customers who are not consumers are subject to the general rules of the Civil Code.
3.1. The sale of the products offered on this website is restricted exclusively to persons aged 18 or over. Purchase by persons under 18 is expressly prohibited, as is purchase by an adult on behalf of, at the request of, or for the benefit of a person under 18. When creating an account and when completing an order, the customer declares, on their honour, that they are over 18 and have legal capacity to enter into the contract.
3.1.1. Confirmation of majority is required at two separate points: when the customer account is created and when each order is completed. A false declaration as to age renders the contract null and void and leads to the immediate cancellation of the order, without prejudice to any liability that may arise.
3.2. Mundilar Airguns reserves the right to request, at any time before dispatch, proof of age and of identity, as well as any licence, authorisation or document required by law in order to acquire or hold the product ordered. Failure to provide the documents requested within the stated period will result in cancellation of the order and full refund of the amounts paid.
3.3. Legal regime for weapons and ammunition. The products sold on this website are subject to the legal regime for weapons and their ammunition approved by Lei n.º 5/2006, de 23 de fevereiro (Law No. 5/2006 of 23 February) and other applicable legislation. Mundilar Airguns sells only class G compressed air weapons, in calibres 4,5 mm and 5,5 mm, with a maximum power below 24 J, which may be sold freely to persons aged 18 or over.
3.4. It is the customer's sole responsibility to ensure that the acquisition, importation, possession and use of the product ordered are lawful in the country of delivery, and to check the applicable formalities, including any import licences, taxes and customs duties. Mundilar Airguns is not responsible for orders held, seized or destroyed by the authorities of the country of destination as a result of failure to comply with those formalities.
3.5. Resale. Products are sold for the customer's own use. Mundilar Airguns may refuse orders where there are objective indications that the purchase is for resale, in particular quantities clearly exceeding personal use, repeated orders of the same item within a short period, or identification of the customer as a trader in the sector without a prior commercial agreement.
4.1. Prices are shown in euros and include VAT at the applicable statutory rate. They do not include shipping costs, which are calculated and shown separately before the order is completed, according to destination and weight.
4.2. The price applicable to the contract is the price displayed on the website at the moment the order is completed. Subsequent price changes do not affect orders already confirmed.
4.3. Price reduction announcements. Whenever a price reduction is announced, the prior price shown is the lowest price charged by Mundilar Airguns in the 30 days preceding the start of the promotion, in accordance with Decreto-Lei n.º 70/2007, de 26 de março (Decree-Law No. 70/2007 of 26 March), as currently in force.
4.4. Obvious errors. In the event of a computer error, technical failure or obvious mistake resulting in a clearly incorrect price or piece of information, Mundilar Airguns will inform the customer as soon as possible and offer either to correct the order or to cancel it, with a full refund of everything paid. This applies only to obvious errors that a good-faith buyer would recognise as such, and not to promotional prices or to changes in commercial policy.
4.5. Product images are for illustration only. In the event of any discrepancy, the specifications set out in the product data sheet prevail. Accessories, optics and sights are not included unless the data sheet expressly states otherwise.
4.6. Orders are subject to a minimum value of 20 €, excluding shipping costs.
4.7. If, after an order has been confirmed and paid for, a product turns out to be unavailable, Mundilar Airguns will inform the customer and refund the amount corresponding to that product, together with the shipping costs if the order is cancelled in full.
5.1. An order is placed through the following steps: selection of the products and addition to the basket; customer identification; entry of the delivery and billing addresses; choice of shipping method; choice of payment method; review of the order summary; and final confirmation.
5.2. Before completing the order, the customer is shown a summary setting out the main characteristics of the products, the total price including VAT, the shipping costs and any other charges, the payment method, the delivery time and information on the right of withdrawal.
5.3. The order is deemed to be completed when the customer clicks the button labelled "Order with obligation to pay". By clicking that button, the customer accepts the obligation to pay the total amount shown.
5.4. Once the order is completed, the customer receives by email, on a durable medium, the order confirmation with the order number, details of the products and amounts, a copy of these Terms and the withdrawal form.
5.5. Refusal and cancellation by Mundilar Airguns. Mundilar Airguns may decline an order, or cancel it after acceptance, in the following situations:
In any of these cases, Mundilar Airguns will inform the customer by email, stating the reason, within a maximum of 5 working days, and will refund in full any amounts already paid within a maximum of 14 days.
5.6. Fraud prevention. Orders are subject to a partly automated check designed to detect suspicious transactions. If an order is flagged, the customer is informed and has the right to obtain human intervention by a member of Mundilar Airguns staff, to express their point of view and to contest the decision, by writing to [email protected]. Further information is available in the Privacy Policy.
6.1. The following means of payment are accepted: credit or debit card, Multibanco reference, bank transfer, PayPal and cash on delivery (mainland Portugal only). No other means of payment are accepted.
6.2. For card or PayPal payments, the amount is debited when the order is dispatched.
6.3. For payments by Multibanco reference or bank transfer, processing of the order begins once the payment has cleared. If payment is not received within 3 calendar days of the order date, the order is automatically cancelled at no cost to the customer.
6.4. Payment data is transmitted over an encrypted connection directly to the payment service provider. Mundilar Airguns neither accesses nor stores the customer's full card details.
6.5. Invoicing. The invoice is issued using SAGE invoicing software certified by the Portuguese Tax and Customs Authority and is sent to the customer together with the goods.
7.1. Destinations. Mundilar Airguns delivers within Portugal and to the following countries: Germany, Belgium, Bulgaria, Slovakia, Spain, Estonia, Finland, France, Greece, Hungary, Italy, Lithuania, Luxembourg, Monaco, Norway, the Netherlands, Poland, Romania, Sweden and Switzerland. Some products may be subject to shipping restrictions for certain destinations, for legal or transport reasons; those restrictions are stated on the product data sheet or communicated to the customer.
7.2. Delivery times. Deliveries are made from Monday to Friday, between 9 a.m. and 6 p.m., except on public holidays. The estimated delivery time is stated on each product data sheet and in the order summary. In any event, and unless otherwise agreed, delivery is made within a maximum of 30 days from the day after the contract is concluded.
7.3. If Mundilar Airguns fails to deliver within the agreed period, the consumer may set an additional period appropriate to the circumstances and, if delivery is not made within that additional period, terminate the contract and obtain a refund of everything paid within 30 days. The consumer may terminate the contract immediately, without setting an additional period, where Mundilar Airguns has stated that it will not deliver or where the agreed delivery date was essential.
7.4. Delivery does not include a scheduling service; the carrier does not contact the recipient in advance. Someone must be present at the address given.
7.5. Transfer of risk. The risk of loss of or damage to the goods passes to the consumer only when the consumer, or a third party indicated by the consumer other than the carrier, has acquired physical possession of the goods. Until that moment, the risk lies with Mundilar Airguns.
7.6. Damage in transit. We recommend that the customer check the condition of the packaging on delivery and, if damage is found, refuse the delivery or record the incident on the carrier's delivery note — this makes matters easier and quicker to resolve. Failure to follow this recommendation does not cause the customer to lose any rights: if damage is found after receipt, the customer should contact us at [email protected] and the matter will be resolved at no cost to the customer.
7.7. Loss in transit. If the order has not been delivered, we ask the customer to let us know as soon as possible, ideally within 30 days of the order date, so that we can open a claim with the carrier. This period is intended to make resolution easier and does not entail the loss of any rights the customer has under the general law.
7.8. Change of address. The delivery address may be changed while the order is still being prepared, by contacting [email protected].
8.1. The consumer has the right to withdraw from the contract, without giving any reason and without any penalty, within 14 calendar days.
8.2. Calculation of the period. The period runs from the day on which the consumer, or a third party indicated by the consumer other than the carrier, acquires physical possession of the goods. Where several goods ordered in a single order are delivered separately, the period runs from receipt of the last item.
8.3. How to exercise the right. To exercise the right of withdrawal, the consumer must inform us of their decision by means of an unequivocal statement, and may use the withdrawal form available on the website (its use is not mandatory), sent to:
To meet the deadline, it is sufficient for the communication to be sent before the 14 days expire. Where the communication is received electronically, Mundilar Airguns will acknowledge receipt on a durable medium within 24 hours.
8.4. Return of the goods. The consumer must return the goods without undue delay and in any event no later than 14 days from the date on which the withdrawal was communicated, to the address given in clause 8.3.
8.5. Cost of returning the goods. The direct cost of returning the goods is borne by the consumer.
8.6. Refund. Mundilar Airguns will refund all payments received, including delivery costs, within a maximum of 14 days from the date on which it is informed of the decision to withdraw, less, where applicable, the diminished value calculated in accordance with clause 8.7. The refund is made using the same means of payment used for the purchase, unless expressly agreed otherwise, and at no cost to the consumer. If the consumer chose a type of delivery more expensive than the standard type offered, only the cost of the standard type is refunded. Mundilar Airguns may withhold the refund until it has received the returned goods or until the consumer supplies evidence of having sent them back, whichever is the earlier.
8.7.1. The right of withdrawal is intended to allow the consumer to examine the item — not to use it. The consumer may open the packaging carefully, take the item out, look at it and handle it as they would in a physical shop with a display model, and must then repack it in its original packaging.
8.7.2. Acts going beyond examination of the item. The following do not constitute examination but use:
8.7.3. Any of these acts causes the item to lose its status as a new product and, with it, commercial value. Under Article 14 of Decreto-Lei n.º 24/2014 (Decree-Law No. 24/2014), the consumer is liable for the resulting diminished value, which is deducted from the amount to be refunded.
8.7.4. How diminished value is calculated. The deduction corresponds to the difference between the price paid and the value at which the item can be sold in the condition in which it is returned. By way of guidance:
| Condition of the returned item | Indicative deduction |
|---|---|
| Original packaging damaged, incomplete or missing | 20% |
| Seals, labels or protective films removed | 20% |
| Accessories, manuals, certificates or documentation missing | Replacement price of the missing item |
| Sight, mount or accessory fitted, with clamping or mounting marks | 25% |
| Weapon fired or otherwise used | 40% |
| Components drilled, tapped, machined, engraved or painted; optics with scratched lenses; item with damage preventing resale | Up to the full loss of commercial value established |
8.7.5. Transparency of the process. Before processing the refund, Mundilar Airguns informs the consumer in writing of the amount deducted and the criterion applied, together with photographic evidence of the condition in which the item was received. The consumer may contest the assessment by writing to [email protected].
8.7.6. Completeness of the return. The return must include the item, the original packaging and all accessories, manuals, guarantee certificates and other documentation received.
8.7.7. Recommendation to the customer. If you are considering returning an item, do not use it, do not fit any accessory and keep the original packaging intact. An item returned in the condition in which it was received gives rise to a full refund; an item that has been used gives rise to a reduced refund, which in cases of significant damage may be minimal. If you are unsure whether a product is compatible, contact us before using it — we will be glad to help.
8.8. Exceptions to the right of withdrawal. The right of withdrawal does not apply, among the other cases provided for in Article 17 of Decreto-Lei n.º 24/2014, to contracts for the supply of goods made to the consumer's specifications or clearly personalised, or to sealed goods which are not suitable for return for health protection or hygiene reasons once they have been opened.
8.9. Returns outside the statutory period (commercial policy). Once the 14-day withdrawal period has expired, acceptance of returns is a discretionary gesture by Mundilar Airguns, subject to the following cumulative conditions, failure to meet which results in refusal of the return:
This policy does not apply to, and does not affect, the right of withdrawal set out in clauses 8.1 to 8.8 or the consumer's rights in the event of lack of conformity, set out in clause 9.
8.10. Exchanges. Mundilar Airguns does not carry out direct product exchanges. If the customer wants a different item, they should exercise the right of withdrawal as set out above and place a new order. This rule does not affect the consumer's rights in the event of lack of conformity, set out in clause 9.
9.1. Period. Under Decreto-Lei n.º 84/2021, de 18 de outubro (Decree-Law No. 84/2021 of 18 October), Mundilar Airguns is liable to the consumer for any lack of conformity which becomes apparent within 3 years of delivery of the goods.
9.2. Presumption. Any lack of conformity which becomes apparent within 2 years of delivery is presumed to have existed at that date, unless this is incompatible with the nature of the goods or with the nature of the lack of conformity. After that 2-year period and until the end of the 3 years, it is for the consumer to show that the lack of conformity already existed at the time of delivery. Under the law, the consumer is not required to report the lack of conformity within any particular period; it is enough that they exercise their rights within the guarantee period.
9.3. Consumer rights. In the event of a lack of conformity, the consumer is entitled, free of charge, to have the goods brought into conformity by repair or replacement, at the consumer's choice, unless the option chosen is impossible or would involve disproportionate costs. If bringing the goods into conformity is not possible, is not carried out within a reasonable time, causes significant inconvenience to the consumer, or if the lack of conformity persists, the consumer may also opt for a proportionate price reduction or for termination of the contract, with a refund of everything paid.
9.4.1. The restoration of conformity is carried out free of charge with respect to the labour and material costs necessary for the repair or replacement of the good.
9.4.2. Sending the item to Mundilar Airguns. It is the customer's responsibility to deliver the equipment to our premises. The costs of sending the good from the customer to our store are always the customer's own responsibility.
The customer is responsible for packaging the equipment adequately, preferably in its original packaging, in order to prevent damage during transport.
9.4.3. Return to the customer and manufacturer costs. The cost of transporting the repaired or replaced item back to the customer's address is borne in full by Mundilar Airguns, as are all labour and materials costs and the cost of sending the item on to the manufacturer or to the authorised service centre.
9.4.4. Situations in which the costs are borne by the customer. Where a technical assessment establishes that there is no lack of conformity — in particular because the matter involves normal wear or a wear part within the meaning of clause 9.7, a consumable, or a cause attributable to the customer or to a third party within the meaning of clause 9.8 — Mundilar Airguns informs the customer of the outcome of the assessment and provides a quotation for the work. In that case:
This rule does not apply whenever a lack of conformity is confirmed, in which case no cost is charged to the consumer.
9.5. How to make a guarantee claim. The procedure is as follows:
9.6. Commercial guarantee. Some manufacturers offer their own commercial guarantees. Those guarantees are in addition to the legal guarantee of conformity and never replace or limit it. Their conditions, duration and territorial scope are set out in the guarantee statement supplied with the product.
9.7.1. The products sold incorporate components whose deterioration results from operation itself and which therefore have a limited service life and are expected to be replaced periodically. Wear of those components, where it occurs within normal parameters of use, does not constitute a lack of conformity, since it corresponds to the performance that can reasonably be expected of the goods given their nature and purpose.
9.7.2. The following are regarded as wear parts, depending on the type of product:
9.7.3. Consumables. Because they are used up in the course of use, the following are not covered by the guarantee of conformity: pellets and other projectiles, CO2 capsules, targets, batteries, oils, greases and cleaning products, and cleaning felts and brushes.
9.8. Exclusions. Without prejudice to the rights conferred on the consumer by law, the legal guarantee of conformity does not cover situations in which the defect results from a cause arising after delivery and attributable to the customer or to a third party, in particular:
9.9. Replacement of wear parts and repairs outside the guarantee. The replacement of wear parts, the supply of consumables and repairs not covered by the legal guarantee are chargeable services, provided against a prior quotation, with clause 9.4.4 applying as regards transport costs.
10.1. Any complaint may be submitted through [email protected] or by post to the address given in clause 1. We undertake to reply within a maximum of 15 working days.
10.2. Electronic Complaints Book. The customer may submit a complaint through the Livro de Reclamações Eletrónico (Electronic Complaints Book) platform, at www.livroreclamacoes.pt.
10.3. Alternative resolution of consumer disputes. In the event of a consumer dispute, the consumer may turn to an alternative dispute resolution (ADR) body for consumer disputes, under Lei n.º 144/2015, de 8 de setembro (Law No. 144/2015 of 8 September). The body with jurisdiction over disputes arising from contracts concluded with Mundilar Airguns is CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (www.arbitragemdeconsumo.org). A consumer resident in another Member State of the European Union may also contact the European Consumer Centre in their country of residence, part of the ECC-Net network, which provides free assistance in cross-border consumer disputes.
10.4. The European Commission's Online Dispute Resolution (ODR) platform ceased operating on 20 July 2025, under Regulation (EU) 2024/3228, and is no longer available for submitting complaints.
11.1. Mundilar Airguns is liable under the general law for any loss caused to the customer by breach of its contractual and legal obligations.
11.2. Mundilar Airguns applies appropriate technical and organisational measures to ensure the security of the website and of transactions. Even so, the security of communications over the Internet cannot be fully guaranteed. To the extent permitted by law, Mundilar Airguns is not liable for loss resulting from failures, delays, interception or manipulation of electronic communications by third parties, or from the transmission of computer viruses, where such events are not attributable to it.
11.3. Nothing in these Terms excludes or limits Mundilar Airguns' liability for wilful misconduct or gross negligence, for harm to life or physical integrity, or the rights conferred on the consumer by law.
11.4. Use of the products. The products sold require responsible handling and compliance with safety rules and applicable legislation. The customer is solely responsible for the use they make of the product after delivery.
All content on the website — text, images, logos, graphics and code — is the property of Mundilar Airguns or of third parties who have authorised its use, and is protected by copyright and industrial property legislation. Its reproduction, distribution or modification, in whole or in part, without written authorisation is prohibited.
The processing of customers' personal data is governed by the Privacy Policy and the Cookie Policy, which form an integral part of these Terms.
Mundilar Airguns may amend these Terms, in particular as a result of changes in legislation or in its product range. The version in force is permanently available on the website, stating the date it was last updated. Changes do not apply to orders already completed, which continue to be governed by the version in force on the date they were completed.
15.1. These Terms and the contracts arising from them are governed by Portuguese law.
15.2. Where the customer is a consumer, they retain the right to bring proceedings before the competent courts under the jurisdiction rules applicable to consumer disputes, in particular the court of their domicile, as well as to turn to the alternative dispute resolution bodies indicated in clause 10.
15.3. Where the customer is not a consumer, the courts of the judicial district of Vagos have exclusive jurisdiction, with express waiver of any other.
If any provision of these Terms is held to be void, invalid or ineffective, the remaining provisions remain in force, and the provision concerned is replaced by a valid provision that comes closest to the intended purpose.
(Complete and return this form only if you wish to withdraw from the contract. Use of this form is not mandatory.)
To: Mundilar Airguns — Celso Lima Unipessoal, Lda., Zona Industrial de Vagos 115-B, 3840-385 Vagos, Portugal — [email protected]
I hereby give notice that I withdraw from my contract of sale for the following goods:
